1. About these terms

These Terms of Service ("Terms") apply to your use of the FlashChargr online store and website and any purchase you make from us (the "Services"). In these Terms, "FlashChargr", "we", "us" and "our" refer to FlashChargr, and "you" refers to the person using the Services or placing an order.

By using the Services or placing an order, you agree to these Terms together with our Privacy Policy, Return and Refund Policy and Shipping Policy, which form part of these Terms. Please read them carefully.

Our store is hosted on Shopify, which provides the online platform that allows us to sell our products to you.

2. Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If any part of these Terms conflicts with those rights, your rights under the law prevail.

3. Using our store

You must be at least 18 years old, or have the consent and supervision of a parent or guardian, to place an order. You agree to use the Services only for lawful purposes and not to interfere with the store's security or operation, attempt to access it without authorisation, or use it to send spam or harmful content.

If you create an account, you are responsible for keeping your login details secure and for activity on your account. Please tell us promptly at flashchargr@gmail.com if you believe your account has been used without your permission.

4. Products and descriptions

We take care to describe and display our products accurately. Colours may appear slightly different depending on your screen, and product images are for illustration. If a product you receive doesn't match its description, you're entitled to a remedy under our Return and Refund Policy.

5. Prices and payment

Prices are shown in the currency displayed at checkout and include any applicable taxes, except where stated otherwise. The total price you pay, including any shipping costs, is shown at checkout before you place your order. Payments are processed securely by our payment providers. We do not store your full card details.

If you pay in a currency other than your own, your bank or card provider may charge conversion or international transaction fees. These are outside our control.

6. Orders

Placing an order is an offer to buy. We accept your order when we dispatch it or send you a shipping confirmation. We may decline or cancel an order in limited circumstances, such as if a product is out of stock, a price or description was clearly displayed in error, or we reasonably suspect fraud. If we cancel an order after you have paid, we will notify you and refund the full amount to your original payment method.

7. Promotions and bundle offers

From time to time we may offer discounts, multi-buy pricing or other promotions. Unless stated otherwise, promotions cannot be combined with other discount codes and apply only while the offer is shown. Returns of items bought under a promotion are handled under our Return and Refund Policy.

8. Shipping and delivery

Delivery estimates and details are set out in our Shipping Policy. We are responsible for your order until it is delivered to the address you provided.

9. Returns and refunds

Returns, refunds and faulty items are handled under our Return and Refund Policy, which operates in addition to your rights under the Australian Consumer Law.

10. Intellectual property

All content on the store, including text, images, graphics, logos and the FlashChargr name, belongs to us or our licensors. You may view and print content for your personal, non-commercial use, but you must not copy, reproduce or distribute it for any other purpose without our written permission.

11. Reviews and communications

If you submit a review, comment or other content, it must be honest, lawful and not misleading, offensive or infringing on anyone else's rights. You give us permission to display it on our store and marketing channels. We may remove content that breaches these Terms. We do not edit reviews to change their meaning or selectively hide genuine negative reviews.

12. Third-party websites

Our store may contain links to websites operated by others. We don't control those websites and are not responsible for their content or practices.

13. Liability

Subject to section 2 and to the extent permitted by law, we are not liable for any loss that is not reasonably foreseeable or that is caused by events outside our reasonable control, such as natural disasters, carrier or customs delays, or interruptions to internet services. We are not liable for loss caused by your misuse of a product, including using it in a way contrary to its instructions or intended purpose.

Nothing in these Terms limits our liability for loss caused by our negligence, fraud or breach of the consumer guarantees, or anything else that cannot be limited by law.

14. Privacy

We handle your personal information in accordance with our Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or our business. The updated Terms will be posted on this page with a new "Last updated" date. Changes apply only to orders placed after the updated Terms are published. The Terms in place at the time of your order continue to apply to that order.

16. Disputes

If you have a complaint or dispute, please contact us first at flashchargr@gmail.com so we can try to resolve it. If we can't resolve it together, you may contact your local consumer protection agency or pursue any other remedy available to you by law.

17. Governing law

These Terms are governed by the laws of Tasmania, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Tasmania and the courts that can hear appeals from them. If you are a consumer located outside Australia, you may also have rights under the laws of your own country that these Terms do not exclude.

18. General

If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the extent necessary, and the rest of the Terms will continue to apply. If we don't enforce a right under these Terms straight away, we can still enforce it later.
